9. [The commissioner of police, with the approval of the Special limits; Secretary of State, may direct that any street or portion of a street within the general limits of this Act is to be deemed within the special limits, or may take the same out of the special limits: Provided-1st. That notice that an order has been submitted for approval shall be affixed to a lamp-post or otherwise placarded in some conspicuous position in or near the street to which it relates, and at the principal office of the local authority having charge of such street, and of the metropolitan police and of the city police

(c) Procedure (s. 27).-As in 2 & 3 Vict. c. 71, ss. 42-50, ante, pp. 596-8. (d) The rest of this section is repealed, and this shall not apply to costermongers, street hawkers, or itinerant traders so long as they carry on their business in accordance with regulations made by the commissioners of police, with the approval of the Secretary of State (31 Vict. c. 5, s. 1).

c. 134.

30 & 31 Vict. respectively, for not less than 28 days previously to approval: -3rd. That a copy of such order when approved shall be published in the London Gazette, and affixed to a lamp-post or Regulation. otherwise placarded in some conspicuous position in or near the street, and while in force be kept so affixed or placarded. A copy of the London Gazette containing such order shall be evidence of the contents of such order and of the same having been duly made and approved, and until the contrary is proved the provisions as to the affixing or placarding such order shall be deemed duly complied with.]

Regulation of metropolitan

11. [The commissioner of police, with the approval of the Secretary of State, and the commissioner of city police, with the consent of the court of mayor and aldermen, and subject to the approval of the Secretary of State, may make regulations to be observed within the special limits:

With respect to the route to be taken by all carts, carriages, or other vehicles, with power to prohibit any cart, carriage, or other vehicle from coming into any street or part of a street within the said limits for the purpose only of passing to its destination in some other street or part of a street:

2. With respect to the line to be kept by persons riding or driving:

And may, with the like approval, alter, vary, or repeal such regulations; but this shall not limit the number of metropolitan stage carriages that may pass down any street in pursuance of their ordinary trade.]

12. Any person wilfully disregarding or refusing to conform to any regulation of the commissioner of police made in pursuance of this Act

[Penalty not exc. 40s. (f); and any constable may take into custody any person who within his view wilfully disregards such regulation, and refuses to give his name and address; a printed copy certified under the hand of the commissioner of police who made the same or purporting to be printed by the Queen's printer, shall be evidence of such regulations, and until the contrary is proved all such regulations shall be deemed duly made.]

13. [A printed copy of all regulations made by the commissioner of police in pursuance of this Act shall be hung up for public inspection in such places as he thinks advisable; but it shall not be necessary in enforcing any regulation to prove that this provision has been complied with, nor shall noncompliance invalidate any regulation.]

14. Within the special limits of this Act no driver of or stage carriages in conductor of a metropolitan stage carriage shall take up or set down passengers at any place where he may for the time being

c. 134. Traffic

15. Between the hours of 10 o'clock in the morning and Regulation. 6 o'clock in the evening no coal shall be loaded or unloaded on Coal and casks in or across any footway within the special limits of this Act, streets. and between the same hours and within the same limits no casks, whether empty or full, (wine or spirits in cask excepted,) shall be lowered or drawn up by means of ropes, chains, or other machinery passing across the footway or any part thereof[Penalty not exc. 40s. 16. No person shall, within the special limits of this Act, Carriage of and between the hours of 10 in the morning and 7 in the timber, &c. evening, except with the permission of the commissioner of

1. Drive or conduct along any street any cart, carriage, or other vehicle laden with timber, metal, or any other article which exceeds in length 35 feet, or which protrudes more than 8 feet 6 inches behind the vehicle or more than 1 foot from the sides of the vehicle:

2. Carry in any way along any street any ladder, scaffold pole, or other article which exceeds 35 feet in length or 8 feet 6 inches in breadth:

3. Drive or conduct along any street any cart, waggon, or other vehicle used for conveying goods or merchandise, and drawn by more than four horses

(h) Procedure (s. 27).—As in 2 & 3 Vict. c. 71, ss. 42-50, see ante, pp. 596-8. (This Act applies only to such towns or districts as shall be comprised in any Act of Parliament hereafter to be passed which shall declare that this Act shall be incorporated therewith, and the clauses of this Act, unless expressly varied, shall form part of such Act (s. 1), herein called the Special Act; "prescribed" means prescribed in the special Act, and "commissioners" means the persons or body entrusted with powers for executing the special Ac (s. 2).

c. 89. Constables. Appointment (k).

6-8. [Where constables have been appointed under 2 & 3 10 & 11 Vict. Vict. c. 93, or 3 & 4 Vict. c. 88, and the justices for the county, in general or quarter session, report to the Secretary of State that such constables ought to be discontinued, and they are discontinued, or where no constables have been appointed, the commissioners may appoint and employ a superintendent and constables, and allow them wages, and may remove any such superintendent and constables;-7. Or where constables have been already appointed, the commissioners may apply to the chief constable of the county to appoint additional constables within the limits, and they may pay the charge out of the rates to be levied under this and the special Act.-8. Any justice may swear in constables under this and the special Act, and such constables shall have, within the limits of the special Act, and in any place not more than 5 miles beyond, the like powers, privileges, and duties, and shall have the same indemnities and protection, and shall be subject to the like penalties and forfeitures, as any constable duly appointed has or is subject to within his constablewick by law.]

9. [The commissioners may defray the expense of prosecuting Expenses of felons or offenders, and of defending any constable in his duty, prosecutions. and make allowances to constables disabled or for length of

service.]

10. No constable appointed under this or the special Act Resignation. shall resign his office, or withdraw himself from the duties thereof, unless expressly allowed so to do in writing by the commissioners or by the superintendent constable, or until after he has given to such superintendent constable one month's notice

[Penalty to forfeit wages due,-or not exc. £5,-or Imprisonment not exc. 14 days (1).]

11. Every constable appointed under this or the special Act Accoutrements. who is dismissed from or ceases to hold and exercise his office shall forthwith deliver over to the superintendent constable, or to such person and at such time and place as the commissioners direct, all the clothing, accoutrements, appointments, and other necessaries which have been supplied to him for the execution of his duty

[Imprisonment not exc. 1 month, with or without hard labour; and any justice may issue a warrant to search for such articles ().]

(1) Procedure (s. 73, under 8 & 9 Vict. c. 20).—Within 6 months; 2 justices (or one magistrate, s. 75). Penalties enforced by Imprisonment, under Small Penalties Act, if not exc. £5 with costs (Introd. p. 32); or by distress (s. 146), in default Imprisonment not exc. 3 months (s. 147): Payable, not exc. half to informer, the rest to the overseers for the poor rate (Id. s. 150).
