A BILL ΤΟ Explain and amend the Act 18 and 19 Vict., for the better Local Management of the Metro polis. W 66 HEREAS by Section Eight of the Act of the last Session Preamble. of Parliament, "for the better Local Management of the 18 & 19 Vict. Metropolis," it is provided that the Vestrymen elected c. 20. s. 8. under the said Act in any Parish should, with such other Persons as 5 therein-before mentioned, be deemed to constitute the Vestry of such Parish, and should supersede any existing Vestry therein, and exercise the Powers and Privileges held by such existing Vestry, save as in that Act otherwise provided: And whereas by Section Ninety of the same Act it was enacted, that all the Duties, Powers, and Authorities 10 for or in relation to the paving, lighting, watering, cleansing, or improving of any Parish mentioned in Schedule (A.) to that Act, or any Part of such Parish vested in any Commissioners, or in any Body other than the Vestry of such Parish, or in any Officer of any Commissioners or other Body, and all other Duties, Powers, and Authorities in anywise relating to the Regulation, Government, or Concerns 15 of any such Parish or Part, or of the Inhabitants thereof, (except such Duties, Powers, and Authorities as relate to the Affairs of the Church, or the Management or Relief of the Poor, or the Administration Powers of @ of any Money or other Property applicable to the Relief of the Poor, 35 and like Meetings of Inhabitants declared to I. The Expression "existing Vestry" in the said Section Eight shall be construed to include all Vestry Meetings, Meetings in the Nature of Vestry Meetings, and Meetings of the Parishioners, Inhabitants, or Ratepayers generally, or of the Parishioners, Inhabitants, or Ratepayers rated at or above any specified Amount or 40 Value which might from Time to Time have been lawfully holden in the Parish if the said Act had not been passed, and from the Time constituted when, according to the said Section Eight, "any existing Vestry" in a Parish was to be superseded by the Vestry constituted under the have been transferred to the Vestries under recited Act. said Act, all the Duties, Powers, and Privileges, (including such as relate to the Affairs of the Church, or the Management or Relief of the Poor, or the Administration of any Money or other Property applicable to the Relief of the Poor,) which might have been per5 formed or exercised by any existing Vestry, or any such Meetings as transferred aforesaid in such Parish, under any Local Act or otherwise, shall be deemed to have become transferred to and vested in the Vestry constituted by the herein-before recited Act; except so far as any such Saving of Duties, Powers, or Privileges may in the Case of a Parish included in Powers 10 any District mentioned in Schedule (B.) to the said Act be vested by to District Section Ninety of the said Act in the Board of Works of such District: Boards. Provided that all Duties and Powers relating to the Affairs of the Church, or the Management or Relief of the Poor, or the Administration of any Money or other Property applicable to the Relief of the Poor which at the Time of the passing of the said Act were vested in or might be exercised by any Commissioners, or any Body other than the then existing Vestry, or such Vestry and other Meetings as hereinbefore mentioned, shall continue vested in and be exercised by such Commissioners or other Body as aforesaid. 15 (No. 2.) A BILL ΤΟ Amend the Act of the last Session of Parliament, Chapter One hundred and twenty, for the better Local Management of the Metropolis. HEREAS it is expedient to amend the Act of the last Preamble. " for the better Local Management of the Metropolis," 18 & 19 Vict. as herein-after mentioned: Be it therefore enacted by the Queen's c. 120. 5 most Excellent Majesty, by and with the Advice and Consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the Authority of the same, as follows: Church Overseers or in like I. Where at the Time of the passing of the said Act any Power wardens or to elect or appoint Churchwardens or Overseers of the Poor in any where 10 Parish, or to elect Persons for Nomination to Justices of the Peace, for elected in the Purpose of such Persons, or some of them, being appointed such open Vestry Overseers, was vested in any open Vestry, or in any Meeting in the Meetings Nature of an open Vestry Meeting, or in any Meeting of the Parishioners, Inhabitants, or Ratepayers generally, or of such of the 15 Parishioners, Inhabitants, or Ratepayers as were rated at or above any specified Amount or Value (whether such Vestry or Meeting same Manwere holden for the Parish at large or for any Liberty or other ner as before the passing [Bill 194.] District of that Act. before the passing of 18 & 19 Vict, c. 120. to be elected in A |
