XXV. ARRANGEMENT OF CLAUSES.

Preamble recites 2 & 3 Vict. c. 93., 3 & 4 Vict. c.88., 5 & 6 W. 4. c.76. Where a Constabulary is not already established for the whole of a County, Quarter Sessions to cause the same to be established; Sect. 1.

CLAUSE A. Saving for Proceedings commenced for the Establishment of a Police.

CLAUSE B. Where a Constabulary has been successively established in Divisions of a County, the Divisional Establishments to be consolidated, and One County Police Force to be constituted. Her Majesty may, by Order in Council, require separate Police Districts to be constituted in Counties; 2.

Her Majesty in Council, on Representations from Boroughs, may arrange Terms of Consolidation with Counties; 3.

County Constables to have the like Powers, &c. in Boroughs as Borough Constables have in the County; 4.

Constables to perform Duties connected with the Police as directed by the Justices or Watch Committee; 5.

Constables not to receive Fees; 6.

Borough Constables disqualified from voting at certain Elections; 7. Retiring Gratuities may be granted to incapacitated Constables who have not served Fifteen Years; 8.

Deficiency in Superannuation Fund to be made up out of Police Rate; 9.

Gratuities may be granted to Officers superseded by the County Police; 10.

Power to grant Superannuations to Chief Constables; 11.

CLAUSE C. Transfer of Payments to Superannuation Fund.

Annual Statement as to Crime in Counties and Boroughs to be furnished to Secretary of State; 12.

Her Majesty may appoint Inspectors for inquiring into Efficiency of

Police, &c.; 13.

On Establishment of an efficient Police, One Fourth the Charge for Pay and Clothing to be paid by the Treasury; 14.

But no Payment to be made to the Police of the Boroughs with a Population under 5,000 not consolidated with County Police; 15. Provisions relating to Borough Police to be applicable to the Police in the Places referred to in the Act 3 & 4 Vict. c. 88. s. 20. until discontinued; 16.

The separate Police in such Places (having a Population of 15,000) not to be superseded without the Authority of the Secretary of State; 17.

Agreements for Consolidation not to be determined without the Sanction of the Secretary of State; 18.

3 & 4 Vict. c. 88. s. 24. repealed; 19.

Station House or Strong Room provided under 3 & 4 Vict. c. 88. may be purchased by Justices and paid for out of County Rates; 20. CLAUSE D. Incorporation of Lands Clauses Consolidation Act, 1845, for Purpose of Purchases of Station Houses, &c. by Justices. CLAUSE E. 7 G. 4. c. 18. extended to unnecessary Station Houses,

&c.

Powers of Cheshire Constabulary Act, 1852, to continue in force in that County until Police established under this Act; 21.

If Two Chief Constables appointed in Cheshire, last preceding Section to be read as applicable to District of each Chief Constable; 22. Provision as to Superannuation Fund under Cheshire Constabulary Act, 1852; 23.

Service of Police under Cheshire Constabulary Act, 1852; 24.

Police Rates in the County of Chester made liable to Annuity to Widow of a deceased Officer; 25.

Interpretation of Terms; 26.

CLAUSE F. 2 & 3 Vict. c. 93. and 3 & 4 Vict. c. 88. to be construed with this Act.

HEREAS an Act was passed in the Session holden in the Preamble. Second and Third Years of Her Majesty (Chapter 2 & 3 Vict. Ninety-three), "for the Establishment of County and "District Constables by the Authority of Justices of the Peace," 5 which Act was amended by an Act passed in the Session holden in the Third and Fourth Years of Her Majesty, Chapter Eighty- 3 & 4 Vict. eight: And whereas a Police Force has been established under the Authority of the said Acts in several Counties and Parts of Counties in England and Wales: And whereas by the Act of the 10 Session holden in the Fifth and Sixth Years of King William the 5 & 6 W. 4. Fourth (Chapter Seventy-six), "to provide for the Regulation of c. 76.

Municipal Corporations in England and Wales," Provision is made

for the Appointment of Constables in all Boroughs in England and Wales which are subject to that Act: And whereas, under the said 15 secondly-mentioned Act, Power is given to Justices of Counties and Councils of Boroughs to agrée for the Consolidation of the County and Borough Police Establishments: And whereas, for the more effectual Prevention and Detection of Crime, Suppression of Vagrancy,
