SUPREME COURT.

JUDGMENT IN THE OPIUM CASE.-Sir David Pollock and Sir Erskine Perry delivered their judgments this morning to a crowded court, in the matter of the demurrer to the plaints in the celebrated action brought by Ramlall and partners against the Bombay speculators. Sir E. Perry read his judgment first, and it was a most elaborate composition. He expressed a most decided opinion in favour of the legality of the opium transactions, however much they might be disproved of as gambling wagers. The Chief Justice, on the contrary, gave judgment for the defendants, thereby establishing the principle, that time bar gains in opium sales are illegal.-Telegraph and Courier Extra, March 5.

SATURDAY. At the sitting of the Court this morning, Mr. Herrick appeared on behalf of Ramlall and others, to make an application in respect of the costs of the late proceedings in the opium case. Nothing had been said when the judgment was delivered as to the costs of the demurrer, but he believed the rule was, that when the judges differed, the case was decided without costs. Both the learned judges observed, that the established practice of the Court in such cases appeared to have been, that each party should pay his own costs, although it certainly seemed fair that the winning party should be exempted from the payment of costs. As it had been the usual course, however, that where the puisne judge differed, no costs should be allowed to either side, it must be pursued on this occasion.

MISCELLANEOUS.

LOCAL.

Mr. Hamilton, resident at Indore, and suite, who have for ten days past been residents at Parell House, leave on their return this afternoon.-Times, March 3.

THE" MEDUSA."-The H.C. steamer Medusa arrived yesterday morning from Vingorla with Major-general Morse and staff on board. The gallant officer will become commander of the forces on the departure of Sir T. McMahon on Monday, and so continue till the arrival of Sir W. Cotton three weeks hence. Sir Willoughby will reach Bombay just after the sixth anniversary of his departure from our shores.-Ibid. March 13.

MILITARY RETIRING FUND.-We have the pleasure to annex, for the information of our military readers, a statement of the number of votes received up to the 12th instant, for and against the institution of a retiring fund for lieutenant-colonels of infantry :

MOFUSSIL.

BARODA, February 25, 1847.-The 3rd company, 3rd battalion Golundauze, complete, with battery equipped with horses, commanded by Brevet-captain Creed, arrived here yesterday morning, from Bhooj, to take the place of the 6th company Golundauze. Cursetjee Jamsetjee, Esq., reached Baroda this morning from Ahmedabad, as anticipated, and was received by a number of respectable Parsees and other persons, who pro. ceeded from the town to a village two koss from camp, to meet him. His object in visiting this place, I am told, is to witness the grandeur of the Guicowar's court; but I think he will be much disappointed in this respect. He will leave this for Surat, after the Holee holidays. The marriage of his Highness the Guicowar's fourth son, by name Mullar Row Guicowar, and now aged about ten years, will take place on or about the 6th proximo. Great preparations, it is said, are being made for the approaching ceremony, and I have no doubt his highness will do his best to display his royal wealth and magnificence on the occasion. Mr. Remington, the political agent in the Rewakanta, arrived here from Ahmedabad this morning. It is rumoured that his stay here will not be long, as he expects to go back as judge of Ahmedabad. He is highly spoken of, as an upright and impartial judge, and his return will no doubt be looked for anxiously by his friends.-Telegraph, March 3.

BELGAUM, March 1.-The right wing of the 13th Bombay N. I., with about ten European officers, under command of Lieutenant-colonel Jones arrived here on the 27th ultimo; the left wing, under Captain Sparrow, having been left at Vingorla, to occupy that station and furnish detachments to the small outposts in the Concan, subordinate thereto.-The left wing of the 3rd Madras L. I. marches for Kulladgee on the 4th instant. It consists of but four companies, with two European officers, one of whom, of course, commands, and the other is his staff! A pretty pass, you will say, for a wing of a native infantry corps to be brought to. The fifth company of the wing proceeded some days since to a place called Wuttore, under command of a subaltern. Not a regiment in the service is probably so badfy off for

officers as the 3rd M. N. I., they having only one major, six lieu. tenants, and four ensigns, to both wings, four of whom, at least, would be required as staff, the corps being separated into wings. The only captain it had-Capt. Yarde, who commanded the left wing-has just left for Bombay on leave.-Mr. De Vitre, the second assistant collector, goes away immediately to Bombay : he has sold all his household furniture, and does not, I believe, return to this station.-Fresh and additional charges have been preferred against the Mamlutdar of Chikodee.-Chintamun Rao, Rajah of Sanglee, is now, I believe, at Dharwar. He seems determined to visit all his friends before returning to "the seat of his government."-A letter from the camp of the 1st M. N.I., dated Hooblee, 25th ultimo, gives the following:-"We left Dharwar this morning, and marched out to this place, where we halt to-morrow to enable all hands to prepare properly for our journey. We are all in good health, only nine in hospital, and they trifling cases. The weather is certainly very hot, and the authorities deserve our best thanks for their great kindness in delaying our march till this time of the year!-Times, March 6.

- March 4.-You will, I am sure, regret to hear of the death of poor Assistant-surgeon William Bowie, M.D., of the 78th Highlanders, who died at nine o'clock this morning. His death was fearfully sudden: disease, inflammation of the brain. He entered the service in June 1842, and was a talented man. His death is sincerely regretted by his brother officers. The sick list of the 78th is said to continue very high, the prevailing disease, I believe, being dysentery, though not of a very fatal kind. -Ibid. March 10.

March 8.-Orders were received here on Saturday last for General Morse to repair forthwith to Bombay to assume command of the army on the departure of Sir Thomas McMahon. Two expresses were sent on the same day to Kolapore to Col. Reid, the first ordering him to Belgaum as next senior officer to the general, to assume command of the southern division; the second cancelling the first, and directing him not to move till further orders. The latter was dispatched in consequence of Col. Douglas having made a claim to the appointment, on the plea that since the receipt of his nomination to the command of the garrison of Bombay, he had continued in charge of the Highlanders, and that during that time any superior command vacancy occurring in the division in which his corps is quartered, falls to him by right and the usages of the service. Two days previous to Gen. Morse receiving the order to repair to the presidency, Colonel Douglas's appointment to the commandantship of the Bombay garrison was received here, and published in division orders, so that I think he had no right to continue in command of the Highlanders after its promulgation, unless he wished to decline it, but should immediately have made over command to Colonel Forbes. Colonel Douglas has, however, made out a strong claim to the command of the S. D. A., and it has been forwarded to Bombay for decision. General Morse leaves us this evening for the presidency, a steamer awaiting his arrival at Vingorla. Captain Shaw, deputy-assistant commissary-gen. has assumed charge of his duties; and a general hope prevails here that a separate officer will be appointed to the police and bazaar departments. Captain Birdwood left us this morning in progress to Aden, carrying with him the best wishes of the station.-Ibid. March 13. POONAH, March 8.-Colonel Pennefather, c. B., H. M.'s 22nd foot, lately appointed to succeed Major-general McNeil in the Poonah command as a brigadier, arrived here on the 5th, and entered cantonments under a salute of eleven guns. The latter has not yet left Poonah, but will I believe do so shortly. The man of the 4th troop H. A. whom I mentioned a short while since as having had his arm amputated owing to an accident at a field-day, is I am glad to say doing well. There has been a great change in the weather since my last-morning pleasant, midday and night sultry. The 3rd troop H. A. have ten sick, the 4th thirteen, the 10th hussars fifty-four, the 8th foot ninety-four, the 22nd sixty-four, and the wing of the 86th eighteen.-Ibid. March 10.

COURT MARTIAL.-A court martial was held on board H. M.'s ship Daedalus for the trial of Mr. Huxham, midshipman, and Mr. Drew, acting masters' assistant, both serving in the same ship, on Tuesday week last, for certain charges arising out of a quarrel between them, in which the latter received some severe bodily injury. The court was composed of the following officers: -Captain Johnson, H. M. S. Agincourt, President; Captain Mc Quahe, H. M. S. Dædalus: Captain Mundy, H. M. S. Iris; Commander Grey, H. M. B. Columbine. Mr. Penham, paymaster of H. M. S. Dædalus, officiated as Judge Advocate. The court, after hearing the charges, and what the prisoners had to say in their defence, adjudged them guilty, and sentenced them to be dismissed H. M.'s naval service. This was confirmed by his Excellency the naval Commander-in-Chief. On the following day another Court Martial, composed of the same officers and held on board the same ship, assembled for the trial of Mr. Smith, B. A., Naval Instructor of H. M. S. Iris, on a charge preferred against him by Captain Mundy. It was objected on the part of Mr. Smith, that Captain Mundy was not eligible to sit on his trial, inasmuch as he was not only the prosecutor, but had prejudged the case in a letter to the Commanderin-Chief, which letter having been read by the Judge Advocate, the Court-after nearly an hour's consultation-admitted the validity of the objection, and adjourned the trial to await the decision of his Excellency the Commander-in-Chief. We

believe the charge preferred against Mr. Smith was the refusing to take care of the chronometers in the absence of either the master, second master, or master's assistant. We are informed from quarters in which we can place reliance, and we think it only justice to Mr. Smith to mention, that he is said not actually to have refused, but to have respectfully declined the charge of the chronometers, because he was not in the habit of winding up instruments which required the attention and skill of some more experienced hand, and that therefore he considered the charge too responsible for him.-Gazette, Feb. 20.

SINGAPORE.

QUICK PASSAGE-The Spanish brig Quid-Pro-Quo, has just made one of the speediest voyages between this and Batavia on record as having been performed by a sailing vessel at this season of the year. The following are the particulars of her trip. She left this on the morning of the 8th of January last, and arrived at Batavia on the night of the 11th, having been one hour at anchor in the straits. She remained at Batavia 16 days,-left for this on the morning of the 27th of January, and arrived here at seven o'clock A. M. on the 6th inst. She was a day and a half at anchor on her passage up. She returned by the Caramata passage which should always be taken during the N. E. Monsoon in preference to the Banka Straits.- Free Press, Feb. 11.

DINNER TO WHAMPOA, JUN., Esq.-It having been ascertained that Whampoa the younger, whose name is known far and wide in these Eastern parts, and is familiar to not a few even in distant Europe, was about to leave this by the next steamer on a visit to his native country, a few of his friends, amongst the European mercantile community chiefly, resolved to show their respect and esteem for him by entertaining him at dinner. The dinner accordingly came off on Monday evening at the London Hotel, when about twenty sat down, C. Carnie, Esq. in the chair, and W. S. Duncan, Esq. croupier. The health of their guest having been given, Whampoa returned thanks in a most neat and feeling manner in English; and on the health of Kim Seng, one of our most respected Chinese merchants, who was also present, being drank, Kim Seng replied in a clever and humorous speech in Malay, which delighted all present. A number of other toasts were also given, and the evening was spent in much harmony and merriment.-Ibid.

COAL.-We hear that specimens of coal were lately brought to Pinang from Trang on the Peninsula, which promises to be of a very superior description. It is said to be very bituminous, burning with a clear and brilliant flame. Some uncertainty is said to exist as to the precise locality where this coal is to be found, as the Malay by whom it was brought to the master attendants was suffered to depart unquestioned, and could not be afterwards met with. If the coal is of the quality reported, we suppose Government will lose no time in instituting a search for it, as, if it exists in any quantity, it will be of much value from the proximity of its location to Pinang. We have no doubt that a careful exploration of the Peninsula would develope abundant stores of all kinds of mineral wealth.-Ibid., Feb. 18.

CAPABILITIES OF MALACCA.-Malacca and its capabilities for producing sugar and other articles of commerce, seem to be attracting a very large share of attention at present. Another application has been made for a tract of 4,000 acres for a sugar estate, by a French gentleman, who has been engaged in planting operations at the Mauritius, and who, after a thorough exploration of Malacca, pronounces that the soil is of excellent quality for the culture of the cane, the worst soil in Malacca being equal to the best in Singapore. The working of tin is also being briskly carried on within our territories, the right of working it having been let in the beginning of the year for higher rates than previously, and the late excavations having been very productive.-Ibid., March 4.

THE COLUMBINE" AND THE "WOLF."-H. M. S. Columbine left this for Labuan, on the 24th ultimo, to relieve the Wolf. Owing to the reluctance of the natives to receive money in payment of the supplies required by vessels on that part of the coast of Borneo, the Columbine has laid in a large supply of long cloth, which is found the readiest medium of exchange, and which is bartered in different sizes, according to the value of the article to be bought; so many yards representing the price of a bullock, fowls, &c.-Ibid.
