been appointed his successor, and that he would take the oath and his seat in the Common Pleas on Tuesday morning. The announcement was at least premature. We do not know that it is yet positively determined; but it is extremely probable that the rumoured change will be completed before Christmas. The purpose of it seems not to be generally understood. Chief Justice ERLE does not retire from judicial life, but only to the higher honour of a peerage, a place in the appellate tribunal of the House of Lords, which needs strengthening, and the presidency of the Privy Council which Lord KINGSDOWN has resigned. By custom the chiefship of the Common Pleas would have passed to the ATTORNEY-GENERAL, had he been of the Common Law Bar; but as it is Sir W. BOVILL Succeeds to it. And who will be his successor? Patronage has fallen so abundantly into the hands of the present Government that all its leading supMr. HUDDLESTON and Mr. BRETT will be their only remaining silks in the House of Commons, and the choice lies between them. Mr. HUDDLESTON has, indeed, already received the pleasant and profitable office of counsel to the Admiralty; but he has a seniority of political claims over Mr. BRETT, so it is probable that Mr. HUDDLESTON will hand his new office to Mr. BRETT and receive the higher and better one of SolicitorGeneral.

Three of the Common Law Judges are also named as contemplating an early retirement, but by whom they are to be followed even speculation does not hazard a guess. THE late Lord Justice JAMES KNIGHT BRUCE did not long survive his retirement. His health had been rapidly failing for some weeks, and he died on Wednesday. An interesting memoir of him appeared in the Times of the following day. We shall publish our own obituary notice next

week.

We have to announce the death of Mr. Serjeant STORKS at an advanced age. He was called to the bar in Nov. 1803, raised to the degree of the coif in 1827, and was appointed Judge of the Shoreditch County Court, an office which he had quitted for some time. He was the father of Sir HENRY STORKS, K.G.B.

It was positively affirmed in Westminster-hall on Monday that Chief Justice ERLE had actually resigned, that the SOLICITOR-GENERAL had VOL. XLII-No. 1232.

IT is announced that the threatened bill of indictpreferred at the sittings of the Central Criminal ment for murder against Governor EYRE will be Court on Monday, the 19th inst. Should the grand jury find a true bill, the indictment will be removed by certiorari into the Queen's Bench, and the trial will not take place for a twelvemonth. It is a disgrace to our jurisprudence that public servants should be prosecuted by private individuals for official misdeeds, or that their defence should require a public subscription. If they have erred, the Government should prosecute on behalf of the public; if not guilty, the Government should defend a public servant at the public cost. If there had been a public prosecutor the humiliating scene of rival advertisements and partisan appeals on a question of life and death could not have been exhibited.

THE order for winding-up the Inns of Court Hotel Company will be made to-day, and the provisional liquidators will probably be appointed the official liquidators. Their work will be short and easy. In the way of receipts they have nothing but to recover the arrears of calls and to sell the equity of redemption of the hotel. In the way of payments there is still less to be done, for there are not half a dozen creditors altogether. The builders claim a large sum which the architects say they are not entitled to, and this claim was the immediate cause of the winding-up.

The new company to be formed to purchase, complete, and carry on the hotel is already matured. The capital is to be 30,000/. in shares of 51. It was erroneously stated last week that a sum was required to finish the Holborn block. It should have said the Lincoln's-inn

block. The Holborn block is completely built and furnished, and in full work. Nothing remains but the Lincoln's-inn side of the hotel, to finish and furnish which 20,000l. will be ample. This will add seventy beds to the establishment, and, therefore, if half occupied, a revenue of 351. per day.

The proposed Legal Club promised to be quite successful. It will, of course, form part of the plan of the new company.

The shares in the new company will be first offered to the shareholders in the old company, who will probably subscribe all, or the greater portion of them. Indeed, a considerable number are already taken. It would be lamentable if such an establishment were to be turned to other

uses.

Ar a general meeting of the shareholders of the Inns of Court Hotel Company, held a short time ago, a committee of investigation was appointed to examine into the precise position of the company, and to consider the best means of meeting the difficulties that had arisen from the stoppage of the subscription of the debenture loan caused by the panic. They proposed that the shareholders should take up 10.0001. of these debentures at 7 per cent., which would have enabled the company to proceed. The appeal was made, but not responded to, and the following circular from the committee announces the result:

THE QUEEN'S ANCIENT SERJEANT. THE report of the conferring of the dignity of Queen's Ancient Serjeant upon Mr. BACON, Q. C., proves to be premature. We understand that it was offered, but, from a very delicate and honourable sense of the claims of existing Serjeants, declined by the learned Counsel. The successor to Mr. Serjeant MANNING is not yet determined.

MR. COMMISSIONER KERR AND THE

COMMON COUNCIL.

IT is understood that the report of the committee completely exonerates Mr. Commissioner KERR from the charges that had been made against him by certain members of the Common Council, of whom it was whispered that on some occasion he had given judgment against them, and hence the hostil ty that gave birth to the committee of investigation whose report has just been made. It is so far satisfactory that the Judge of the Sheriffs' Court should be formally relieved from unjust censures; but it is monstrous that it should be in the power of disappointed suitors or personal enemies to arraign a judge before a selfappointed tribunal, and try him upon accusations of ill-temper, discourtesy, and such like-not for maladministration of justice. The treatment to which Mr. Commissioner KERR has been subjected is decisive evidence, if any be wanting, against the practice of choosing judges by popular election. Because Mr. Commissioner KERR was elected by the Common Council, he was looked upon by some of its members as a kind of upper servant; expected to take off his hat to his masters, and

even to incline the scale of justice to them. They deemed themselves entitled to call him to account for a word, a look, a tone, not altogether to their taste, and they put him upon his defence accordingly-or rather sought to do so, for he did not acknowledge the authority. It is due to the majority of the Common Council, and especially to the members of the committee, to say that they did not join in the attack, and by many the Commissioner was zealously defended. But they fell into the error of giving a hearing to the complaint. It should have been summarily dismissed as out of the jurisdiction, instead of appointing a committee to investigate, a proceeding which implies the right to inquire, and if to inquire, to call upon the judge for his defence, and if to hear a complaint and a defence, to pronounce a verdict and inflict a punishment; all which proceedings are entirely to be condemned as ultra vires on the part of the electors and derogatory to the office of judge; and now, when the mischief is done, it is discovered that the complaint itself was without foundation.

THE POST-OFFICE AGAIN. A COMPLAINT similar to that received last week from Burton comes to us now from Epsom. There also an attempt is being made to deprive the inhabitants of their right to the Sunday delivery of their letters and journals. The Postoffice very foolishly conceded to some outlying villages this stoppage of the post where twothirds of the inhabitants consented to it. There was some reason for it in such cases, for usually the postman had a long journey from the central post-office, and a still longer journey to deliver. But the case is very different in towns and large villages, where the delivery can be completed before church time. To stop the letters of persons living in such localities is sheer despotism, even if two-thirds of those who receive letters be willing to dispense with them.

But it seems that at Epsom the required majority is sought to be obtained by procuring the signatures of servants, children, and all kinds of persons who rarely receive letters, and whose opinion on the matter is therefore worthless. Should this trick succeed, our correspon

made? If the benchers will not appoint one
until after the experiment has been tried, let it
be tried. If the use of the Middle Temple Hall
were given for one evening in the week, a small
admittance fee would make the effort self-sup-

suggestion, let them so intimate to us, and we
will try to put it into formal shape.

MR. BRIGHT'S LAND SCHEME.

WITH its subsequent explanation, Mr. BRIGHT'S
scheme for redistributing the land of Ireland is
not so revolutionary as it appeared when it
startled the public on its first announcement.
It was supposed to mean the seizure of the
estates of certain Whig and Conservative noble-
men, whom Mr. BRIGHT named, giving them
compensation as railway companies take and give,
and the division of them among the tenants, they
paying the price at which the estates were com-
pulsorily bought. This was, of course, confis-
cation, and it was applauded or condemned

Nobody will question the imperative necessity for improved elocution on the part of our clergymen, and they cannot preach well if they read badly. As it is, a tolerable reader is rare, a good reader a phenomenon. But, to read well is no less a requirement of the lawyer, whether barrister or solicitor, and reading is an art which nature does not teach, though some natural qualifications are needful. It must be taught and practised. Why should it not form part of the law student's curriculum? A reader of elocution would be more useful than any of

The whole of the facts indeed have been collected by the Citizens' Association of New York, a body of property-holders, professionals, and men of leisure, recently organised to obtain a thorough reorganisation in the administration of the city.
