Lloyd, on behalf of the plaintiff, appeared to show cause, but, as no notice had been given of Winstanley's intention to show cause in the first instance, the COURT refused to hear him. Rule nisi.

REG. v. BROOKE AND OTHERS.-Mellish, Q. C. (Cole with him) applied on behalf of Mr. Brooke and others for a rule for an information in the nature of a quo warranto, calling on the defendants to show by what authority they claim to exercise the office of members of the Huddersfield Local Board of Health, on the ground that certain votes by which they had obtained a majority were bad. The question was one of construction of the Huddersfield Local Act, and sundry clauses in the Towns Improvement Clauses Act (10 & 11 Vict. c. 34), and the Commissioners Clauses Act 1847 (10 & 11 Vict. c. 16).

Rule nisi.

FLETCHER V. THE COCKERMOUTH LOCAL BOARD OF HEALTIL -Kemplay moved for a rule to set aside an award, the submission not having been made a rule of court.-The COURT refused to hear Kemplay until this was done, but would allow him to amend the defect and renew his apAplication on the last day of term, contrary to the usual practice.

COATES V. MARTIN.-Udal moved to set aside an award on the ground that the defendant had had no notice of the arbitrator's intention to proceed. Rule nisi.

KIRK . MANNING.-Codd showed cause against a ru'e for a new trial obtained by the plaintiff, on the ground of surprise in an action tried at the Whitechapel County Court.-Daly in support of the rule.

REG. v. METROPOLITAN RAILWAY COMPANY. — Lumley Smith moved to make absolute a rule for a mandamus, directing the defendants to request the sheriff to summon a jury to assess compensation for certain lands required by the company.

REG. v. GROOM.-Codd applied to enlarge a rule till next term on affidavits of the attorney showing that the rule had only been served on Wednesday, and that he had not had time to prepare for the hearing.—Macnamara opposed. Rule enlarged.

Re JEFFERY (app.) v. MAJOR (resp.).-Karslake, Q. C. moved for a rule to strike out a case stated under the provisions of 20 & 21 Vict. c. 43, by certain justices for the county of Devon, on the ground that it had not been sent to the Crown-office in time. The case was received from the justices by the appellants on 20th Oct., a copy was delivered to the respondents on the 23rd, but the case was not deposited at the Crown-office till the 24th. The case of Banks v. Goodwin, 32 L. J., N. S., M. C., 87 referred to. Rule nisi.

BENSON AND OTHERS v. CROSS AND FAWCETT.-Maule, Q. C. moved for an information in the nature of a quo warranto, calling on the defendants to show by what authority they claim to hold the office of members of the Huddersfleld Local Board of Health, on the ground that some of the votes polled for them were bad. Rule nisi.

BROWN v. DIx.-Harrington moved for leave to alter the name of a person in a subpoena, leave to serve which had been granted by the Court.

Leave granted to amend the subpoena, or to serve a fresh one. JELL V. THE MAYOR, &C. OF BIRMINGHAM.-Field, Q. C. moved to refer back to the arbitrator in this matter a special case, from which certain particulars had been omitted.

CHARLES PEARSON V. GREAT NORTHERN RAILWAY COMPANY.-Coleridge, Q. C. moved to make absolute a rule which had been served on the company, and to which they did not appear. Rule absolute.

REG. v. KNOTT.-Harrington showed cause against a rule obtained on the 23rd, calling on him to show cause why a surcharge made by him as poor-law auditor, should not be removed into this court and quashed. A parishioner, rateable as occupier in respect of certain lands, had been rated under the Small Tenements Act, in consequence of which he only paid three-fourths of the rate he was bound to pay. The reason for making this allowance did not clearly appear upon the ratebook, and the auditor thereupon surcharged him with the difference.-Field, Q. C. in support of the rule.-(See Reports.) Rule discharged.

THE MADRID BANK (LIMITED) v. BAZLEY AND OTHERS.— Milward, Q. C. and C. Russell showed cause against a rule obtained by Powell, Q. C., calling on the defendants to show cause why an attachment should not issue against them for not obeying an order of the court, directing them to auswer interrogatories. The defendants were ordered to answer as directors, but the affairs of the bank were in liquidation, and by the issuing of the order their functions had ceased.-Powell, Q. C. and Laxton in support of the rule were not called upon.- (See Report.) Rule absolute. Re STUCHBURY.-Macintyre applied to have this case, which had been struck out, replaced, and the rule to be enlarged. Application granted. FLETCHER V. THE COCKERMOUTH LOCAL BOARD OF HEALTH. -Kemplay moved to make an award in this case a rule of court absolute in the first instance. The original submission of the defendants to arbitration was contained in

a copy of a resolution passed by the defendants at their meeting, and sent in a letter to the plaintiff. It was now sought to make this submission a rule of court in order that the award might be set aside, on the ground that the plaintiff had no notice of the proceedings of the arbitrator. Rule absolute to make the submission a rule of court; rule nisi to set aside the award.

THE SALWEEN-Stabey moved on the part of the holder of a bottomry bond, on ship, freight, and cargo, that it

should be paid out of those funds.-Cohen, for material man, applied that in this case an equitable marshalling should take place between ship, freight, and cargo, part of the bond having been given for salvage services rendered solely to the cargo.-Clarkson, for owner of cargo, insisted that ship and freight should be first exhausted.-Butt, for shipowner, applied that in any order the court should make there should be a reservation of the master's lien for wages and general average. Cur. adv. vult.

THE EMPEDOCLE.-Clarkson moved on part of bond holders.-Dr. Deane, Q. C., on part of owners of cargo, asked for a reference. The reference granted.

THE ATALANTA-This was a suit against the ship for wrongful delivery of cargo, plaintiffs had detained the ship but being subsequently paid by counter claimants of cargo, surrendered her.-Brett, Q. C.; now moved to dismiss the suit and condemn the plaintiffs in damages for wrongful detention and costs. Clarkson appeared for plaintiff.-The suit was dismissed with costs

No damages allowed.

THE ELIZA SHAW. Damage. This was a sitting for examination of witnesses and hearing. The Eliza Shaw,

on her passage from China bound for the port of London, came into collision with the San Telmo of Rouen, bound

for Bristol, laden with olive oil, on 10th Oct. last, off Start Point; the San Telmo, besides considerable damage to the

bowsprit, jib-boom, and apparel of the ship, had a large number of oil casks stove in, &c.-The COURT decided that the Eliza Shaw was solely to blame. Judgment accordingly.-Dr. Deane, QC. and Cohen for plaintiffs; Brett, Q. C. and Clarkson for defendants.-Proctors, Tebb and Son; and Clarkson, Son, and Cooper.

THE TRIO.-Damage. The Prussian barque Trio, loaded with timber from Memel to London, came into collision with the Schleswig Holstein schooner Louise, off the Skagen light in the Cattegat, on the 10th Nov. 1865. This was a sitting for the examination of plaintiff's witnesses.-Dr. Deane, QC. and Rutherford for plaintiffs; Brett, Q. C. and Maclachlan for defendants.-Proctors, Clarkson, Son, and Cooper; and W. E. Duncan.

THE GENERAL WYNDHAM.-Damage. This was a sitting for the examination of plaintiffs' witnesses and the hearing. The evidence for defendant was put in by affidavits. The General Wyndham, bound for Negapatam, on the Coromandel coast, with iron and coals, came into collision with the American ship Lorenzo, laden with general cargo from London to New York, on the 11th Sept. last off St. Catherine's ligh-house. -The COURT was of opinion that the Lorenzo was solely to blame, decision consequently for defendants. - Brett, Q. C. and Clarkson for plaintiffs; Milward, Q. C. and Pritchard for defendants.-Proctors, Clarkson, Son, and Cooper; and Pritchard and Son.

P. BAINBRIGGE-LE HUNT, ESQ. The late Peter Bainbrigge-Le Hunt, Esq., of Ashbourne, Derbyshire, attorney-at-law, who died at Ashbourne on the 26th ult., was the third son of the late Lieut.-Col. Philip Bainbrigge, of Ashbourne (who was killed at the battle of Egmont-op-Zee, Oct. 6, 1799), by Rachel, daughter of Peter Dobrée, Esq., of Beauregard, Guernsey. He was born at Rocester in the year 1793, educated at the Free Grammar School, Ashbourne, and being brought up to the law, was admitted to practise as an attorney in 1816. He assumed the additional surname and arms of Le Hunt by royal sign manual in 1832, being the kinsman of Florence Matilda, relict of W. Fallows, Esq., and the daughter and sole heiress of the Rev. John Le Hunt, rector of Radbourne, Derbyshire, with whom the direct line of the family became extinct. "A few years afterwards," says the Derby Mercury, "leaving the Profession, he took up his residence at Ashbourne, where, by the active part which he took in all affairs affecting the welfare of the place, he proved most useful, and endeared himself to all classes. He had a large share in carrying out the restoration of the parish church, in 1839-40, when he held the office of churchwarden. Whatever be the merits of this work, as now considered, Mr. Le Hunt, in the share he had in it, kept in view the public benefit and the spiritual interests of those concerned, as shown by the care he took that 500 free sittings should be provided for the poor. He was also one of the body of governors and assistants of the Free Grammar School and charities of the town.; indeed, no good work ever appealed in vain to his large heart for assistance, whilst his advice and counsel were ever open to all. Mr. Le Hunt was indefatigable as a magistrate; ever ready to administer justice, and to temper it with an intelligent and perceptive spirit of mercy. His charities were large, but unostentatious. He was an earnest and constant supporter of religious societies, and he took an active share in promoting many excellent institutions. Of late years his failing health prevented his taking so active a part as formerly, but to the last, as far as he was able, he maintained the same interest in the good works he hap promoted through life." Mr. Bainbrigge-Le Hunt was a magistrate for the counties of Derby and Stafford, and a deputy-lieutenant for the county of Derby, besides holding other public offices from time to

The late Edward Yardley, Esq., barrister-at-law, and magistrate of the Marylebone Police Court, who died at 8, Blandford-square, on the 18th Nov., was the eldest son of the late Edward Yardley, Esq., of Shrewsbury, by Catharine, daughter of James Bowen, Esq., of Whitechurch, Pembrokeshire. He was born at Plealey, Shropshire, in the year 1808, and educated at Shrewsbury school, and at Magdalen College, Cambridge, where he was a wrangler and Fellow in 1830. He was called to the bar at Lincoln's-inn in 1834, and went the Oxford Circuit. In 1846 he was appointed one of the magistrates of the Thames Police Court, from which, upon the death of Mr. Secker, some six years ago, he was transferred to the Marylebone district. Mr. Yardley married in 1832 Elizabeth, daughter of John Taylor, Esq., of Everley, Yorkshire, by whom he has left issue.

J. GLYDE, ESQ.

The late John Glyde, Esq., solicitor, who died at his residence, Wyndham-house, Yeovil, on the 5th inst., after a short illness, in the 41st yearof his age, was articled with H. Watts, Esq., solicitor, of that town, and commenced practice in 1850. He was a churchwarden of the parish church, and also a member of the Freemasons' Society. His amiable conduct in all things had won him the highest respect of his fellow townsmen. This is the fourth death in Mr. Glyde's family within as many weeks.

LEGAL NEWS.

FOREIGN TITLES.-In connection with the disputed point as to whether an Englishman can legally bear a foreign title, or wear a foreign order in England without the sanction of the Crown, we (Athenæum) may refer to a precedent in the case of Nelson. He was informed that he could not appear at court as Duke of Bronte and knight of various foreign orders until he had received the usual sanction. Nelson replied that those honours had been conferred on him by his royal master's allies for service he had been deputed by his royal master to render them. He would go to court, he said, with all his titles and all his honours, and he did not suppose anybody would stop him. supposition was correct; nobody ventured to "stop Nelson."

The

COPYRIGHT.-An action against Miss Herbert, manager of the St. James's Theatre, for infringing the rights of a musical composer by performing his music to "Lady Audley's Secret" without his permission, opens up a curious question of law. The music was composed by the plaintiff for Mr. Frank Matthews, and Mr. Frank Matthews, considering the music part of the play, assigned it with the play to the management which succeeded him. In this case the question is, whether the music belongs to the manager or the composer, and it is rather remarkable that the general practice of considering an author the absolute owner has been departed from already with regard to musical accompaniments. A suit in 1859, in which Mr. Charles Kean was the defendant, terminated thus:-Chief Justice Erle stated that as Mr. Hatton's music to "Much Ado About Nothing" had been composed by Mr. Kean's direction, and under his superintendence as part of the general plan of the spectacle, it must be considered his property.

HIS HONOUR THREATENS TO GIVE AN ATTORNEY INTO CUSTODY LEAREY v. CLEGG. Mr. J. C. Roberts (solicitor) was for the plaintiff, and Mr. H. Standring (solicitor) for the defendant. Mr. Roberts stated that the action was brought to recover 31. 3s., under these circumstances:-The plaintiff let a dwelling-house to Clegg in Molesworth-street, at a rental of 127. a-year. He gave him notice to quit on the 1st of May last, or pay double rent for the time he retained possession after that date. Clegg remained in the house till the 1st of August, and consequently there became an amount of six guineas due, half of which the defendant had already paid. These facts being proved in evidence, Mr. Standring contended that no such action as this could lie under any statute. It was stated that the defendant was a quarterly tenant, on which his Honour said he was of opinion that having entered upon the second quarter, Clegg was liable for that quarter's rent. Therefore he would owe three quarters' rent, which would be nine guineas. (Laughter.)-Mr. Standring: You are making a great mistake. The

THE LIABILITY OF CARRIERS. THE Star expresses an opinion to the effect that v. Sutton will not go unchallenged. The decision was that a carrier was liable for the loss of 31. entrusted to him in the form of a parcel. What objection can there possibly be to this decision when the 1st section of the Carriers Act (11 EDITION of Geo. 4 & 1 Will. 4, c. 68) expressly says that no common carrier for hire shall be liable for the loss of gold or silver coin (inter alia) contained in any parcel or package which shall have been delivered to be carried for hire when the value of such article contained in such parcel or REPORTS of JOINT-STOCK COM-package shall exceed the sum of 101.? Is the Star acquainted with any more recent enactment?

Law and the Lawyers.

LEGAL TOPICS OF THE WEEK. We have been given to understand that the proposed increase in the number of Judges, which has so generally been approved of and accepted as a certainty, will meet with very powerful opposition from, amongst others, Mr. GLADSTONE. We also believe that Lord WESTBURY is strongly opposed to the scheme, his Lordship, it is said, being of opinion that there should be a redistribution of the work, that four judges should not sit in banco, and that, indeed, there are few cases where even the attendance of three would be necessary; and that the sittings of Judges in chambers for the amendment of pleadings should be done away with. We are also informed that a gentleman of high position at the Bar, whose name has been mentioned among the probable new Judges, is also of opinion that the proposition is objectionable.

THE Recordership of Cambridge, rendered vacant by the appointment of Mr. R. M. NEWTON to the office of police magistrate at Worship-street, has been conferred upon Mr. J. R. BULWER, Q.C., who at present is Recorder of Ipswich. BULWER was called to the Bar by the Inner Mr. Temple, Jan. 29, 1847.

A RUMOUR is current, based, we believe, on fact, that a legal periodical publication of considerable reputation both with reference to its criticisms and its reports will cease to exist at the end of the present year. This event is of course attributable to the establishment of the Law Reports. We condole with the individuals whose interests are thus injuriously affected, but necessitas publica major est quam privata. We have before expressed our opinion that other similar publications must share the fate which is impending over the contemporary to which we allude, and we repeat the suggestion which we made with reference to the VOL. XLII.-No. 1237.

probably avoid an office whose principal was known to be guilty of literary tastes or scientific tendencies. They have a shrewd suspicion that such an one is not the man for them. It is not that they doubt his legal knowledge, or his practical ability to conduct a case rightly; but they have an instinctive consciousness that he will do nothing more than is right. Intellectual cultivation, if it does not sharpen the moral sense, will not suffer it to be blunted, and it certainly fosters that sense of honour which is characteristic of the gentleman. Knowing this, litigant clients may, as the Times asserts, avoid the solicitor who is anything more than a shrewd lawyer, because they know that he will not do the dirty things and the sharp things which clients too often desire their attorney to do for them, but which they will not do for themselves. But Mr. COLERIDGE addressed himself to the students who aspire to the better class of business, and it was his wise exhortation to them, that they should grace their professional knowledge with the loftiest and most varied ledge would be found useless, no accomplishment intellectual culture, assuring them that no knowworthless.
